Welcome to TastyBoom. These Terms and Conditions ("Terms") govern your access to and use of the TastyBoom platform, including our websites, mobile applications, and related services (collectively, the "Platform"). Please read them carefully. By accessing or using the Platform, you agree to be bound by these Terms.

1. About Us and Acceptance of the Terms

The Platform is operated by TastyBoom ("TastyBoom", "we", "us", or "our"), located at 7 rue Hervé, Montréal, QC H9C 1N2, Canada. By creating an account, placing an order, or otherwise using the Platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Platform.

2. Description of the Service

TastyBoom is an online marketplace that connects customers with independent restaurants and food merchants ("Merchants"). Through the Platform you can browse menus, place orders, pay online, and arrange delivery or pickup.

TastyBoom acts as a technological intermediary that facilitates orders between customers and Merchants. TastyBoom is not the manufacturer or preparer of the food and does not own or operate the Merchants listed on the Platform, except where expressly stated.

To use certain features of the Platform, you must create an account. You confirm that:

Prices, menu items, and availability are set by each Merchant and may change without notice. The total price of an order, including applicable taxes and any delivery fees, is displayed before you confirm your order.

Applicable Canadian sales taxes (including GST and, in Quebec, QST, or HST in participating provinces) are applied in accordance with the law. Once an order is confirmed and accepted by the Merchant, it may not be cancelled except as described on the Platform or as required by applicable law.

5. Payments

Payment is processed at the time your order is confirmed, through the payment methods offered on the Platform. TastyBoom does not store complete sensitive payment card data; payment processing is handled by third-party payment processors in accordance with applicable security standards.

Refunds, where applicable, are handled in accordance with our refund practices and applicable consumer-protection law.

6. Delivery

Where delivery is offered, it may be carried out by the Merchant or by independent delivery providers. Estimated delivery and preparation times are approximate and not guaranteed. Risk and responsibility for the food follow the terms disclosed at the time of the order.

7. Merchant Responsibilities

Each Merchant is solely responsible for the quality, safety, preparation, and accurate description of its food and menu items, and for compliance with applicable health, safety, and food-handling regulations in its jurisdiction. Complaints about food quality should be directed to TastyBoom support, which will coordinate with the relevant Merchant.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with applicable Canadian privacy law, including the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and, in Quebec, the Act respecting the protection of personal information in the private sector (Law 25).

10. Intellectual Property

The TastyBoom name, logo, design, software, and content are the property of TastyBoom or its licensors and are protected by applicable intellectual-property laws. You may not copy, reproduce, or use them without our prior written consent.

11. Limitation of Liability

To the extent permitted by applicable law, TastyBoom is not liable for indirect, incidental, or consequential damages arising from the use of the Platform, from the food supplied by Merchants, or from delays or issues in delivery carried out by independent providers. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Modifications to the Terms

We may modify these Terms from time to time. The updated version will be posted on the Platform with its effective date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the competent courts of Quebec, without prejudice to any mandatory consumer-protection rights you may have in your province of residence.
